First & Second Degree Robbery Penalties in Alaska
Robbery is a serious violent crime. Although it is similar to burglary, due to the fact it entails stealing money or property, the crime of robbery typically involves a victim who suffers actual injury or is threatened with harm. An individual commits the crime of first-degree robbery if he or she takes or attempts to take property from the immediate presence and control of another while being armed with a deadly weapon or states that he or she is armed, uses or attempts to use a dangerous weapon, and causes or attempts to cause serious injury to any other person. First-degree robbery is considered a Class A felony, which is punishable by a maximum prison sentence of 20 years and a fine of up to $250,000.
A person commits the crime of second-degree robbery if he or she takes or attempts to take property from the immediate presence and control of another, prevent or overcome resistance to the taking of the property or the retention of the property after taking, or compel any person to deliver the property or be involved in other conduct that might assist in the taking of property. Second-degree robbery is considered a Class B felony, which is punishable by a maximum prison sentence of 10 years and a fine of up to $10,000.
However, if an individual commits murder of another person during a robbery, he or she shall be sentenced to a definite term of imprisonment at least 20 years but not more than 99 years.
