Defending Those Accused of Sex Assault in Anchorage

Sex crimes pose very harsh consequences, including long prison sentences and having to register as a sex offender if you are convicted. The exact charges you face may vary depending on the circumstances of the crime.

Our firm represents clients who have been charged with sex crimes, including:

  • Criminal sexual assault: Known as “rape” in other states, this crime occurs when a person forces another to have sex, knowing that the victim cannot give consent or refuses to consent, or when the accused uses force or the threat of force. If the victim is a minor, this is also considered sexual assault.
  • Sexual assault of a child: When forced sexual contact is committed by an adult against a victim who is under the age of 13 (a minor child), this is also sexual assault. If there are any other circumstances involved, such as a weapon, the consequences are more severe.
  • Aggravated criminal sexual assault: Forced sexual contact (sexual assault) which involves more aggressive circumstances can lead to enhanced charges. This may include a victim who is more than 60 years old, the use of a firearm or dangerous weapon, and more.

In addition, you may be charged with sexual assault in any of the following circumstances:

  • Engaging in non-consensual sexual penetration with another individual
  • Attempting to engage in non-consensual sexual penetration and causing physical injury to another
  • Engaging in non-consensual sexual penetration with a mentally incapable individual
  • Engaging in non-consensual sexual penetration with an individual in the care of the offender at a state-licensed facility or program
  • Engaging in sexual penetration with an individual who is unaware that the act is being committed, when the offender is a health care worker or the offense occurs during the victim’s professional treatment

Penalties for Sexual Assault

Alaska has come under fire lately for high rape statistics and for “going easy” on offenders. Unfortunately, this means that the pendulum swing to correct this perception could land many individuals with penalties that are disproportionate to the crime, if any crime was committed.

Sexual assault in the first degree is subject to severe penalties. Any previous convictions will only make these penalties more severe.

For a first offense, the penalties could include the following:

  • 25-35 years imprisonment (if the victim is younger than 13 years old)
  • 20-30 years imprisonment (if the victim is 13 years old or older)
  • 25-35 years imprisonment (if a dangerous instrument or firearm caused serious injury)
  • Fines of up to $500,000
