Alaska Drug DUI Laws
According to Alaska law, a person is guilty of DUI if he/she drives a vehicle while under the influence of an alcoholic beverage, a controlled substance, or a combination of both. Similar to alcohol, many illegal drugs and prescription medication can impair reaction time, hand-eye coordination, perception of distance and time, concentration, and short-term memory.
Additionally, driving in the state means you automatically consent to taking a breath, blood, or urine test to determine the amount of alcohol in your system. However, this implied consent law does not apply to controlled substances. So, refusal to take a post-arrest chemical sample will not result in additional penalties or sanctions, unless the arrest involves an accident resulting in physical injury.
Just like an alcohol-related DUI, a first drug DUI offense is a misdemeanor, which carries a jail sentence of up to 72 hours, a fine of at least $1,500, and driver’s license suspension for at least 90 days.
