Drug DUIs

Anchorage Drug DUI Defense Lawyers

Effective & High-Quality Legal Representation in Alaska

In Alaska, not only is it against the law to operate a vehicle under the influence of alcohol, but you could also get a DUI for being impaired by drugs. Even though recreational marijuana is legal is the state, you can still get arrested for drugged driving – just like if you were driving under the influence of a prescription medication. A conviction can lead to serious criminal penalties, such as driver’s license suspension, fines, and the possibility of jail time.

If you or a loved one has been arrested for drugged driving in Alaska, let Denali Law Group protect your rights, reputation, and freedom during the legal process. As former prosecutors, our Anchorage drug DUI defense attorneys have more than 75 years of combined experience handling a wide range of DUI cases. Do not hesitate to let us defend you immediately.

Alaska Drug DUI Laws

According to Alaska law, a person is guilty of DUI if he/she drives a vehicle while under the influence of an alcoholic beverage, a controlled substance, or a combination of both. Similar to alcohol, many illegal drugs and prescription medication can impair reaction time, hand-eye coordination, perception of distance and time, concentration, and short-term memory.

Additionally, driving in the state means you automatically consent to taking a breath, blood, or urine test to determine the amount of alcohol in your system. However, this implied consent law does not apply to controlled substances. So, refusal to take a post-arrest chemical sample will not result in additional penalties or sanctions, unless the arrest involves an accident resulting in physical injury.

Just like an alcohol-related DUI, a first drug DUI offense is a misdemeanor, which carries a jail sentence of up to 72 hours, a fine of at least $1,500, and driver’s license suspension for at least 90 days.
